Terms and Conditions for Network Services
These terms and conditions govern your use of network services provided by Banana Brands (Wifi Poa Networks).
1. Acceptance of Terms
1.1 By subscribing to and using the network services provided by Banana Brands, you agree to comply with and be bound by these terms and conditions.
1.2 Banana Brands reserves the right to update, modify, or revise these terms at any time. Notice of changes will be provided through appropriate channels, and continued use of the services after changes constitutes acceptance of the modified terms.
2. Services
2.1 Banana Brands will provide network services, including but not limited to internet access, data transmission, and related services, subject to the terms outlined herein.
2.2 The quality and speed of the network services may vary based on factors beyond Banana Brands’ control, such as network congestion, technical limitations, and external interference.
3. Subscriber Responsibilities
3.1 Subscribers are responsible for maintaining the security of their network access devices, including routers, modems, and passwords.
3.2 Subscribers must comply with all applicable laws and regulations while using the network services and refrain from engaging in any illegal, harmful, or disruptive activities.
4. Billing and Payments
4.1 Subscribers agree to pay the fees associated with the selected network service plan. Fees may include monthly service charges, usage charges, and additional fees for optional services.
4.2 Billing cycles, payment methods, and late payment penalties will be outlined in the Network Provision Service Agreement signed between parties.
5. Service Availability and Maintenance
5.1 Banana Brands will make reasonable efforts to ensure the continuous availability of network services. However, services may be interrupted for maintenance, upgrades, or other reasons. Notice of planned downtime will be provided when possible.
5.2 Banana Brands is not liable for any loss or damages resulting from service interruptions, outages, or network issues beyond its reasonable control.
6. Privacy and Data Security
6.1 Banana Brands will collect and process subscriber information in accordance with its privacy policy, which is available on the company's website.
6.2 Subscribers are responsible for securing their data and are encouraged to use encryption and other security measures to protect sensitive information.
7. Termination of Services
7.1 Banana Brands reserves the right to terminate or suspend services if a subscriber violates these terms and conditions or engages in activities that compromise the integrity or security of the network.
7.2 Subscribers may terminate services by providing notice as outlined in the Network Provision Service Agreement between parties.
8. Limitation of Liability
8.1 Banana Brands shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use the network services.
8.2 Banana Brands' total liability, if any, shall not exceed the total fees paid by the subscriber for the specific service giving rise to the claim.
9. Governing Law and Dispute Resolution
9.1 These terms and conditions are governed by the laws of the United Republic of Tanzania. Any disputes arising under or in connection with these terms shall be resolved amicably through mediation within 30 days from the date of the dispute, failure to resolve the dispute, parties shall be at liberty to refer the matter before a competent court in the United Republic of Tanzania.
10. Miscellaneous
10.1 These terms constitute the entire agreement between the subscriber and Banana Brands and shall supersede any prior agreements, whether written or oral.
10.2 If any clause or term of this Agreement should be invalid, unenforceable, defective or illegal for any reason whatsoever, then the remaining terms and provisions of this Agreement shall be deemed to be severable and shall continue in full force and effect unless such invalidity, unenforceability, defect or illegality goes to the root of this Agreement.
By using Banana Brands' network services, you acknowledge that you have read, understood, and agreed to these terms and conditions.
